On December 14, 2024, at 7:24 PM, the Exercise of Authority by President Yoon Suk-yeol of South Korea Was Suspended

On December 14, 2024, at 7:24 PM, the impeachment decision document from the National Assembly of the Republic of Korea was delivered to the Presidential Office, and from that moment, President Yoon Suk-yeol‘s exercise of authority was suspended. The National Assembly conducted a vote on the impeachment motion of President Yoon Suk-yeol based on constitutional procedures. For the impeachment motion to pass, more than 200 members of the National Assembly had to vote in favor. The motion was ultimately passed with 204 votes in favor, 85 votes against, 3 abstentions, and 8 invalid votes.

Around 6:16 PM on December 14, Kim Min-ki, the Secretary General of the National Assembly, and other National Assembly Secretariat officials arrived at the Presidential Office in Yongsan with the impeachment decision document. After waiting for about an hour, they visited the main office of the Presidential Office and delivered the impeachment decision document, signed by National Assembly Speaker Woo Won-shik, to Senior Secretary Yoon Jae-soon. As a result, President Yoon Suk-yeol is now unable to exercise the powers vested in the office of the head of state and the head of the executive branch under the Constitution of the Republic of Korea.

Under the Constitution of South Korea, the president’s powers include:

▲ Commanding the armed forces ▲ Ratifying treaties
▲ Granting pardons, commutations, and restorations of rights ▲ Vetoing bills ▲ Proposing and promulgating constitutional amendments ▲ Promulgating amendments to laws ▲ Proposing the national budget ▲ Issuing administrative regulations ▲ Appointing and dismissing public officials.

Furthermore, once the original impeachment decision document is submitted to the Constitutional Court, the impeachment trial procedure will begin. The Constitutional Court must reach a decision within 180 days of receiving the case. If the Constitutional Court ’upholds‘ the impeachment motion, the impeachment is confirmed, and a new presidential election must be held within 60 days.

However, if the Constitutional Court ’dismisses‘ or ’rejects‘ the impeachment motion, President Yoon will resume his duties.
